The Delhi court on Tuesday had extended Baliyan’s police custody by a day, allowing further investigation, following arguments by both the prosecution and the MLA’s legal team. Police argued that Baliyan needed to be confronted with the two victims who have come forward with new allegations. According to the prosecution, victim ‘A’ claimed that an associate of Balyan had forcibly taken over his property, while victim ‘B’ alleged that he threatened to sell his property at a loss.
Delhi’s Rouse Avenue court granted bail to AAP MLA Naresh Balyan. On November 30, he was arrested by the Delhi Police Crime Branch in an alleged extortion case. The AAP MLA was arrested again as soon as he got bail. Now action has been taken against him in the MCOCA case. Earlier, Uttam Nagar MLA Baliyan was in police custody following allegations of his involvement in a syndicate linked to gangster Kapil Sangwan. The case dates back to last year, when Balyan has been accused of threatening property owners through gang members to sell their properties at low prices.

The remand application said the detail was important to unearth the “deep connection” between Balyan and the syndicate and identify his associates. Senior advocate Manish Vashishtha, representing Balyan, argued that the arrest was baseless. Vashishtha said that I (Baliyan), myself, am a victim and the police has made me an accused. They have arrested a public servant and have not given any reason for doing so. The arrest is completely illegal and without any basis.
