The Motor Accident Claims Tribunal (MACT) has given a major verdict while hearing the case of death of a person in a road accident in the year 2021. The tribunal has announced a compensation of Rs 1.5 crore to the family of the deceased. This decision of the Tribunal is being discussed a lot. Let us tell you that this incident happened on February 13, 2021 when 31 year old Lakshminarayan Tarnirao Pulkala died in a road accident.
How did the accident happen?
Actually, the victim Lakshminarayan was going towards Palghar district of Maharashtra on his bike. During this time, a truck coming from behind hit his bike. After the collision, the victim fell down and the truck passed over his head. The petitioners’ counsel told the tribunal that the victim had died on the spot. The deceased was the owner of a labor supplier firm and earned Rs 12.95 lakh annually.
Tribunal gave strict order
The deceased’s wife, mother and minor child had demanded compensation of Rs 2.17 crore in the petition. Let us tell you that the truck owner did not appear before the tribunal, hence the tribunal passed an ex-parte order against him. Tribunal member SN Shah directed the truck owner and its insurer to jointly and severally pay the amount with interest at 8 per cent per annum from the date of filing of claim till recovery of the amount. If these people do not pay the compensation amount within the stipulated period, then interest at the rate of 8.50 percent per annum will be charged on the amount.
The distribution of compensation in the family is also decided
The compensation amount includes Rs 1.06 crore for loss of future dependency, Rs 42.68 lakh for loss of future prospects, Rs 15,000 for loss of property and funeral expenses and filial consortium, the tribunal said in the order. Rs 40,000 is included for this. Along with this, the tribunal has also divided the amount. Rs 70 lakh will be paid to the wife of the deceased. FD of Rs 30 lakh each will be made in the name of her and her child. At the same time, Rs 20.1 lakh will be paid to the mother of the deceased.
