Lawrence is currently lodged in Sabarmati Central Jail in Ahmedabad, Gujarat. After his alleged involvement in the firing incident at Salman Khan’s residence in April this year came to light, Mumbai Police filed several applications but could not succeed in taking the notorious gangster into custody. The main reason is an order by the Union Home Ministry, which prohibits the transfer of Bishnoi from Ahmedabad’s Sabarmati jail.

what is the reason

In August 2023, the Union Home Ministry took a major step and extended the ban on the activities of notorious gangster Lawrence Bishnoi. This decision was taken in view of the criminal record of Lawrence Bishnoi. This ban will remain in force till August 2025. It has been imposed as per the provisions of Section 303 of the Indian Civil Defense Code of 2023 (Section 268 of CrPC).

What does Section 303 say?

The Indian Civil Code or BNSS has been introduced to modernize and update the existing criminal law framework in India. The purpose of the new legal provisions is to further strengthen the law and order system. Under Section 303 of the BNSS, the government has the right to impose restrictions on the activities of any prisoner to maintain security and public safety. This section is similar to the old section 268 of CrPC. Under this, a ban can be imposed on taking the prisoner out of the jail.

Interrogation in the jail premises itself

According to DIG Shrimali, if any police or agency wants to interrogate him, they will have to give a judicial order and any investigation regarding him should be done in the jail premises only. We have not received any such request recently. While senior Gujarat Police officials refused to confirm or deny whether Bishnoi was being kept in a separate cell in the jail. Officials confirmed that he continued to exercise the rights of any other undertrial at the prison facility in Ahmedabad.
