The High Court issued notice to the Enforcement Directorate (ED) on a petition challenging the summons issued to the former Delhi Chief Minister on a complaint filed by the agency in the case.

The Delhi High Court on Tuesday sought the Enforcement Directorate’s response on AAP leader Arvind Kejriwal’s plea challenging the summons issued to him on the agency’s complaint in a money laundering case related to the alleged excise scam. Justice Manoj Kumar Ohri refused to stay the hearing of the criminal case and said the lower court order, which has been challenged by Kejriwal, was two months old and there was no fresh order.

The High Court issued notice to the Enforcement Directorate (ED) on a petition challenging the summons issued to the former Delhi Chief Minister on a complaint filed by the agency in the case. Kejriwal’s lawyer questioned the maintainability of the complaint on the grounds that the summons was issued by one officer, while the complaint was filed by another officer. The former Delhi chief minister has challenged the September 17 order of the sessions court, which had rejected his plea challenging the summons. ED’s counsel raised preliminary objection to the maintainability of the petition.

Kejriwal had moved the sessions court against the magistrate court’s order directing him to appear before it on the ED’s complaint. He had challenged the summons issued by the magistrate court after taking cognizance of two complaints filed by the ED to evade the summons issued to him. The ED had filed complaints before the magisterial court and demanded that Kejriwal be prosecuted for ignoring multiple summons issued to him in a case related to Delhi’s now defunct excise policy.
